Boulder County Illegal Gathering Lockdown Order.

On Wednesday, September 23rd Jeffrey J. Zayach, MS (not an MD BTW) purported to use “science” to infringe on the rights of a specific group of US Residents.  There are a few things that are interesting about this obviously unconstitutional order;  It is targeted at UC Boulder students specifically (though this is not an order from the University), it targets specific addresses which happen to be Fraternity and Sorority houses and it does not spell out the “science” as to the harm to those 18-22 year old’s.   It talks about the potential harm to the community and probabilities of current virus spread and future spread.  The order reads as follows (click the link to read the whole order):

“Hereby finding it is essential that the spread of the novel coronavirus SARS-CoV-2, responsible for the COVID-19 disease, be slowed to protect the ability of public and private health care providers to handle the influx of new patients and safeguard public health, and because the risk of the rapid spread necessitates immediate action to protect all members of the community, especially community members who are most vulnerable to COVID-19 and also health care providers and first responders, and pursuant to the statutory authority granted the Executive Director of BCPH, the following is ordered:

1. Gatherings of any size within the city of Boulder that include any person or persons between
the ages of 18 and 22 years are prohibited.
2. Stay-at-Home: The following shall apply to all Subject Properties listed in Exhibit A:
a. Stay-at-Home Residents are prohibited from leaving their Subject Property except
for Essential Activities and Essential Travel.

b. If a Stay-at-Home Resident must leave their Subject Property for an Essential

Activity or Essential Travel, such Stay-at-Home Residents are prohibited from using
any mode of public transportation or rideshare (e.g. bus, plane, taxi, train, Uber, Lyft,
etc.).
c. All persons who are not a resident of a Subject Property are prohibited from entering
on or into any Subject Property unless they are an Essential Visitor.
d. Stay-at-Home Residents must stay at their residence at the Subject Property unless
relocating to an Alternative Location as outlined in Paragraph 6.d.ii.
e. If a Subject Property has four (4) or more residents, residents should not congregate
in common areas of the Subject Property, should wear a Face Covering when in all
common areas, and should maintain social distancing of at least six (6) feet from all

The Fourteenth Amendment equal protection under the law reads:

“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

At what point, do citizens stand up and fight this tyranny!  In Boulder, you have an out of control public official attacking a segment of the population he dislikes with the heavy hand of government.  To make an order that basically prohibits talking to anyone outside of the legal occupants of a residence reeks of the practice in China of locking people inside their apartment buildings until they starved to death.  Is that what we want in this country?  What an outrage to our civil liberties!  Where are the civil libertarians on this?  This needs to stop now!
